Judge to hear motions from missing boy's father

Thursday, October 7, 2010

PORTLAND, Ore. (AP) -- An Oregon judge will hear two pending motions on Thursday from the father and stepmother of a boy missing since June.

Kaine Horman says he suspects his wife, Terri Horman, to be involved in the disappearance of 7-year-old Kyron Horman.

Kaine Horman has filed for divorce and a restraining order against her.

Judge Keith Meisenheimer will hear Kaine Horman's motion questioning the source of money Terri Horman used to pay her lawyer, Stephen Houze, an amount he claims totals $350,000.

Terri Horman's attorneys deny she paid that much.

Terri Horman says in filings that she will agree to a dissolution of her marriage, but is asking Meisenheimer to delay resolution of other issues, such as financial settlements.

Kyron Horman Update: Dozens of Searchers Scour Island for Missing Boy

October 11, 2010 12:53 PM Posted by Naimah Jabali-Nash

PORTLAND, Ore. (CBS/KOIN/AP) Searchers returned to a Portland-area island for the second consecutive weekend looking for clues to the whereabouts of missing 8-year-old, Kyron Horman.

This past weekend more than 100 people scoured Sauvie Island, about 15 miles outside of Portland, seeking evidence that may help find the second grader who disappeared five months ago.

The last person to report seeing Kyron is his stepmother, Terri Horman, who said she last saw him walking toward his classroom after a school science fair.

Despite rain, dozens of volunteers showed up again this weekend and dedicated their time to aid in the search.

Sheriff's Office spokesperson Mary Lindstrand said the searching is not based on any new information, but, rather they are following up on leads from the very beginning of the investigation, reports CBS affiliate KOIN.

Teams used string to grid off areas they already searched and while there were no specific focal points for the search, many people concentrated on a road that runs north-south on the large island.

"The grid lines give them a line to follow so they know that the area inside the line has been searched," Lindstrand told KOIN." "It just gives them a straight place to start from."

Most of the searchers worked on foot, but horses, canine units and ATVs were also used. Law officers would not indicate whether any significant clues were found as the weekend's search came to a halt Sunday evening.

Authorities have offered a $50,000 reward for information leading to the missing boy.

Anyone with information about the case is asked to contact the Tip Line at 503-261-2847.

Kyron Horman Update: Missing Boy's Father Claims Stepmom is "Severely Emotionally Disturbed"

October 27, 2010 5:44 PM Posted by Naimah Jabali-Nash

PORTLAND, Ore. (CBS/KOIN) The father of Kyron Horman, the Portland-area boy who mysteriously vanished nearly five months ago, has argued in newly filed court papers that his estranged wife is "severely emotionally disturbed" and should not have custody of their 23-month-old daughter.

Kaine Horman alleged in court documents filed Monday Terri Horman is an alcoholic who suffers from an "undiagnosed personality disorder" and that giving her custody of their daughter, Kiara, could endanger the child.

He said he fears his daughter may have witnessed an "unimaginable act of horror," according to CBS affiliate KOIN.

Terri Horman was the last person to report seeing 8-year-old Kyron walking toward his second grade classroom after a school science fair June 4. She has not been named a person of interest or suspect in the boy's disappearance.

Kaine Horman once again said he believes his wife is responsible for his son's disappearance and cannot be trusted near their daughter.

"Her actions are horrifying and unexplainable. Kiara's physical and emotional safety are now at extreme risk," he said.

In July he claimed that Terri Horman suffered from postpartum depression following Kiara's birth.

Also included in the documents are over 20 pages of sexually explicit text messages between Terri Horman and Michael Cook, a high school friend of Kaine Horman, supposedly sent less than one month after Kyron disappeared, reports KOIN.

The messages also mention the use of a "clean phone" to avoid monitoring; and in one instance Terri allegedly asks Cook to deny that she visited him.

Kaine Horman claimed it was common to see Terri passed out on the couch after drinking, which affected their daughter's sleeping pattern, reports KOIN. He also described Terri as too concerned with her looks and her social media life, calling the amount of time she spent online "unhealthy."

Prior to these most recent filings, Kaine Horman filed for divorce and filed a restraining order against Terri Horman after police said she tried to hire a landscaper to kill him in December 2009.

Terri Horman fights back
By KATU News and the Associated Press

Story Published: Oct 30, 2010 at 7:21 PM PDT
Story Updated: Oct 30, 2010 at 11:10 PM PDT

PORTLAND, Ore. – The stepmother of the missing Skyline elementary student Kyron Horman is striking back.

This comes four months after the Portland-area boy went missing and four days after her estranged husband filed court documents implying she had something to do with Kyron's disappearance and resisting her request to share custody of their toddler.

In response, Terri's attorneys filed a legal motion Friday blasting Kaine. In the motion Terri Horman's attorneys say Kaine Horman is focused on his wife's destruction rather than their daughter's best interests. The motion also alleges Kaine is out to sabotage Terri's mother-daughter relationship with the 2-year-old Kiara.

Authorities have focused on Terri Horman during their investigation into the June 4 disappearance of 8-year-old Kyron Horman.

The move comes after Kaine's lawyers filed a motion of their own. In it Kaine called his estranged wife "an emotionally disturbed individual focused on her own needs rather than the needs of Kiara or my missing Kyron." The court filings also included [WARNING: The text in the link that follows is indeed explicit] sexually explicit text messages Terri reportedly exchanged with one of Kaine's friends.

Missing Ore. boy's stepmom drops bid to see daughter

By KATU News Staff  Story Published: Nov 4, 2010 at 9:46 AM PDT  Story Updated: Nov 4, 2010 at 9:46 AM PDT

PORTLAND, Ore. – Terri Horman has filed a motion with the court to dismiss her request for parenting time with the nearly-2-year-old daughter she shares with Kaine Horman, father of missing Skyline elementary student Kyron Horman.

It was a month ago that Terri Horman began her legal fight for visitation with her daughter, Kiara, after she won a court victory to put Kaine Horman's divorce proceedings on hold. The judge agreed that continuing with the divorce would jeopardize Terri's 5th Amendment rights and all matters in the divorce have been held over until Jan. 6, 2011.

Terri's lawyers have said they believe it is cruel to continue to deny Kiara the right to have contact with her mother but at the same time they concede that Terri cannot possibly fight for custody without stating her case, which could jeopardize her right against self incrimination.

An observer of the legal fight, family law attorney Drew Bobzien, said Terri's lawyers had to pick their poison between halting the divorce and handcuffing their fight for visitation. He says Terri picked her right to stay silent over her desire to see her daughter.

"She can't take the stand, she can't be deposed, she can't present evidence that the police won't give her," Bobzien said. "So her position at the end is let's keep the status quo, but she's screaming at everybody, 'I want you to know I'd like to see my daughter, but it's not in my daughter's best interest.'"

Terri's lawyers acknowledge she is the subject of the criminal investigation into Kyron's disappearance but they say Kaine's side has unfairly inflamed the public against her by saying she has failed lie detector tests and by releasing sexual text messages between Terri and one of Kaine's high school friends.

Bobzien said the more the fight between the two sides continues to drag on, the less chances Terri has of getting custody back.

"The longer dad has the case, the less likely mom is to get custody because family law is a lot about patterns that get established," said Bobzien.

But in court filings, Terri Horman reserved the right to apply for the right to see her daughter in the future.

Kyron search: Dive teams back on Sauvie Island

By KATU News and KATU.com Staff
11/13/2010

PORTLAND, Ore. – Dive teams from eight different agencies were back out on Sauvie Island Saturday, searching for clues to the disappearance of Portland elementary student Kyron Horman.

A spokesperson for the Multnomah County Sheriff's Office says about 50 people were part of the search, including paid workers and volunteers.

Multnomah County Sheriff Public Information Officer Mary Lindstrand tells us the search was only in the water. Near the end of the day Saturday Lindstrand said searchers "found nothing of note" – that she can tell us about.

Lindstrand said the dive teams will be at the search again on Sunday.

This search comes just days after Kyron's father Kaine reiterated to a Multnomah County Court judge that he thinks his estranged wife, Kyron's stepmother Terri, had something to do with his then-7-year-old boy's disappearance from a Skyline School science fair. In the most-recent court filing, Kaine asked a judge to sanction Terri in some way if she refuses to testify in court.

Oregon Island Searched in Missing Boy Case

Published November 15, 2010

Dive teams resumed their search of an Oregon island for any sign of missing 8-year-old Kyron Horman, who disappeared more than five months ago.

Lt. Mary Lindstrand of the Multnomah County Sheriff's Office said the teams were at Sauvie Island -- a northwest Portland island -- over the weekend, looking for any clues in the boy's disappearance.

The island has been a focal point in the past in the search for Kyron, who was last seen June 4 after a science fair at his Portland elementary school, Skyline School.

Eight law enforcement agencies and fire departments assisted in Saturday's search, kptv.com reports.

Authorities would not say if a new lead prompted to them to resume the search at that location, according to the station.

Kyron's father: Ex-wife was master of deception

Updated Nov 15, 2010 - 5:27 pm By DAN MITCHINSON

The father of missing 8-year-old Kyron Horman called his ex-wife, Terri, 'a master of deception.'

Kaine Horman told reporters Monday the relationship between Kyron's biological mom, Desiree Young, and step-mom Terri was 'strained.'

"The relationship was strained to the point where I saw it straight away at least a few months out. Her and I were getting into arguments all the time about her relationships just with the children in general and how I wasn't finding it acceptable," Horman told reporters at a news conference.

Horman said he believes his nearly 2-year-old daughter may have seen what happened to her brother the day he disappeared.

"I think he's alive. I think it was an awful day. I sure hope that Kiara didn't witness what happened that day, but I'm pretty confident that she was there based on what we know," Horman said.

He still believes Terri had something to do with his son's disappearance and said 'she could have done it on her own, or with an accomplice.'

Kyron disappeared from his school near Portland, Oregon June 4.

While no arrests have been made, Terri Horman has been a focus of the investigation.

6 months since Ore. boy disappeared
Come Friday, it will have been six months since 8-year-old Kyron Horman mysteriously disappeared from his school.

PORTLAND, Ore. -- Come Friday, it will have been six months since 8-year-old Kyron Horman mysteriously disappeared from his school.

The missing boy's family issued a statement in anticipation of the grim aniversary.

"We recognize that it has now been 6 months since Kyron went missing and we are still deeply saddened that he is not home with us. We feel the investigation continues to move forward in a positive manner and is progressing toward finding out what happened to Kyron," the statement said.

The family added they're still receiving regular updates from law enforcement officials, and are confident the boy will be found.

"We all still remain focused and relentless in the pursuit of bringing Kyron home," said the statement, which also urged the public to keep an eye out for the boy.

"We would like to stress to everyone that Kyron has not yet been found and we need everyone's help. We still need everyone willing to pass out fliers and/or post them in high visibility areas. If you are travelling, attending holiday events, out shopping, or even shipping packages from your business you can help.

"We can help get fliers to you if you need them to pass out, post, or ship. Kyron still needs all of us.

"We love you Kyron and we will never give up hope," the statement said.

The boy disappeared after his stepmother, Terri Moulton Horman, dropped him off at Skyline Elementary School on June 4.

Terri has not been named as a suspect; however, there is some speculation of a possible involvement.

An acquaintance said the woman was very upset in the weeks before her stepson vanished because her husband, Kaine Horman, was making her teenage son move out of the couple's Portland home.

According to the acquaintance, who wished to remain anonymous, Terri came to a 24-Hour Fitness a month or two before Kyron Horman disappeared. Terri was furious and complained to anyone who would listen that her husband was allegedly making her teenage son move out, the acquaintance said.

Terri's son did move out of the home in March. And friends who exercised with Terri at the fitness club testified before a grand jury in August.

Kaine Horman, father of the missing boy, filed for divorce on June 28. He also filed a restraining order against Terri after investigators told him she conspired to have him killed. Kyron is Kaine's son from a previous marriage, and the couple has a daughter together.

Investigators conducted additional searches in August near Skyline School, as well as three other sites with connections to Terri's friend named DeDe Spicher, according to sources.

Lawyer and former Multnomah County Capt. Bruce McCain said the searchers could very well be looking for one of at least three cell phones friends purchased for Terri under fictitious names.

"They're looking for physical evidence," McCain said. "Either something physically associated with Kyron himself, any kind of tools or implements that may have been involved in his disappearance criminally, and also possibly a discarded cell phone that they'd like to retrieve and gather all the data from that."

The sheriff's office confirmed the searches were tied to the Horman case, but would not say what searchers were looking for.

Sources at the courthouse would not confirm the alleged rift between Terri and Kaine in the days before the boy's disappearance, and whether it could have been a possible motive.

Terri's attorney, Stephen Houze, said his client is receiving "threats of harm," and is having trouble finding a place to live. He called the media coverage and the investigation a "witch hunt" against his client.

No arrests have been made in the case.

Parents issue new plea for missing Oregon boy
The parents of Kyron Horman, who was last seen June 4, are reminding the public that help is needed in finding their son.

By the CNN Wire Staff December 3, 2010 6:27 a.m. EST

STORY HIGHLIGHTS

    * More than $1 million has been spent on the effort to find Kyron Horman so far
    * The 8-year-old has been missing since June
    * No arrests have been made in his disappearance

(CNN) -- The biological parents of an Oregon boy missing for six months have issued a new appeal to help bring the 8-year-old home.

Kyron Horman was last seen June 4. His stepmother, Terri Horman, said she dropped him off at school that morning.

In divorce filings, Kaine Horman said he believes his estranged wife, Terri Horman, "is involved" in the boy's disappearance. The stepmother has been the subject of intense scrutiny for several months. Court documents also allege Terri Horman attempted to hire a man to kill her husband.

No arrests have been made in Kyron's disappearance.

"We feel the investigation continues to move forward in a positive manner and is progressing toward finding out what happened to Kyron," his biological parents, Kaine Horman and Desiree Young, told CNN affiliate KGW in Portland. "Briefings continue with law enforcement on a regular basis and we remain confident in the commitment of law enforcement and in the mission to find our son."

More than $1 million had been spent on the effort to find Kyron, Multnomah County Sheriff Dan Staton said in September.

"We have taken critical hits in all of the units throughout the agency to support this investigation," he said at the time.

The boy's parents urged the public not to forget their son.

"We all still remain focused and relentless in the pursuit of bringing Kyron home," they told KGW. "We would like to stress to everyone that Kyron has not yet been found and we need everyone's help. We still need everyone willing to pass out fliers and/or post them in high visibility areas. Kyron still needs all of us."

Kyron's parents marked his 8th birthday in September by releasing red balloons outside a church in Medford, Oregon.

The boy's disappearance prompted his school -- Skyline Elementary -- to add additional security measures to protect the children and staff. In a letter to parents, Principal Ben Keefer said video cameras would be installed at the school.

"These cameras will show external views of the building as well as the main hallway," he wrote.

Security procedures will be reviewed to ensure they are effective, he added.

Search for Kyron Horman resumes today north and west of Portland

Published: Sunday, January 30, 2011, 5:00 AM     Updated: Sunday, January 30, 2011, 9:08 AM

The seven-month search for missing Kyron Horman turns its focus today on two rural locations north and west of Portland as investigators run down specific intelligence they've developed and warmer weather conditions now provide a window of opportunity.

Between 40 to 50 search-and-rescue workers, along with up to seven cadaver-detecting dogs, will be combing the dense forested area around turnouts, trailheads, and gated logging roads along a stretch of Northwest Skyline Road, south of Rocky Point Road and a gravel road further north in the Dixie Mountain area.

The private timber land crosses into unincorporated areas of Multnomah, Washington and Columbia counties, and reaches elevations of between 1,000 and 1,500 feet.

"Weather conditions prevented the searching of these two locations a month or six weeks ago because of the snow up there, and dogs are not effective when it's below 40 degrees," said Multnomah County Sheriff's Sgt. Keith Krafve, a supervisor of the Kyron Horman Task Force.

"There're very specific reasons why we're here," said Multnomah County deputy sheriff Mark Herron, a search and rescue coordinator on the task force.

"We'll be looking for all those things that are Kyron associated," he said, adding that the searchers will also be looking for anything that might have been left by those involved with Kyron's disappearance.

Kyron hasn't been seen since he disappeared from Skyline School the morning of June 4. His stepmother Terri Moulton Horman had driven him to school early that morning for the school science fair and told investigators she last saw him walking to his classroom about 8:45 a.m. He never made it to his class but wasn't reported missing until that afternoon, after his father, Kaine Horman, and stepmother discovered he was not aboard the school bus after school. They went to the school to find him, prompting the school secretary to call 9-1-1 at 3:46 p.m.

Today's search will mark the latest in what's already been the largest search operation in the state's history with no evidence of the boy unearthed.

Stacks of maps in the Multnomah County Sheriff's Office "war room" plot the 155 square miles already scoured, mostly land around the school, property around the Horman home off Northwest Sheltered Nook Road, and land and waterways surrounding Sauvie Island, the focus of the most recent searches.

Investigators declined to identify the leads directing them to these two new locations. But past searches at Sauvie Island resulted from the analysis of cell phone tower pings, viable tips, or statistical probabilities from studies of other missing child cases, officials said.

"We're not going to be out searching anything unless we have an investigative purpose," Herron said.

The locations that will be combed today are remote, with residences few and far between. On Saturday, a heavy fog shrouded the wooded area for most of the early morning, and few cars passed. Ground searches will be directed to specific turnouts, trailheads or areas that a vehicle could pull in, and then conduct a 300-foot radius search of the sites, depending on the steepness of the terrain.

"You could see the hazards we're going to face," Herron said, stepping over discarded screens, wood filled with nails, broken glass and shotgun shells at one gated logging road off Northwest Skyline Boulevard, south of Rocky Point Road. The spot is about 20 to 22 miles from Skyline Elementary School.

"Time has gone by, yes," Herron said. "However, the things that we'll be looking for. If they're there, they're still going to be there."

Joining the Multnomah County Sheriff's Office search and rescue unit will be volunteer searchers from Search One K9 Detection, North Oregon Regional Search and Rescue (NORSAR), Oregon K9 Search Teams, Mountain Wave Emergency Communications Inc., Yamhill County dog team and Pacific Crest Search Dogs (Skamania County).

Although authorities have not named anyone a suspect, it's clear from court documents and testimony in the pending divorce between Kyron's father and stepmother that Terri Horman remains at the center of the inquiry, as well as a handful of associates and friends of hers. No arrests have been made.

Horman, living in Roseburg with her parents, has not made any statements and is represented by prominent criminal defense attorney Stephen Houze.

The search also comes as Multnomah County Sheriff Dan Staton is preparing a written report updating county commissioners on the status of the nine-member multi-agency task force dedicated to investigating the missing boy's disappearance. In October, Staton submitted a 120-day business plan for the task force, and obtained an extra $209,000 to cover overtime and an investigative technician dedicated to the team. As of Nov. 29, the investigation had cost nearly $1.4 million.

Staton last week said he doesn't intend to seek additional funds, and plans to go before the board of commissioners sometime in late February to give a status report on whether or not the task force will continue its full-time work.
